The federal pictureThe CFTC has sued nine states to assert exclusive jurisdiction over event contracts, and opened a Regulation 40.11 rulemaking on sports contracts in June 2026. With the 3rd Circuit backing operators and district courts in the 9th and elsewhere backing states, most observers expect the split to reach the Supreme Court.
